Navigating Complex Party Wall Procedures for a Fulham (SW6) Rear Extension

As Party Wall Surveyors, we know that dense urban environments present unique challenges. Period terrace properties in Fulham (SW6)—typically Victorian and Edwardian builds—leave zero margin for error when it comes to structural alterations and excavations.

We recently acted on a completed rear extension project in Fulham that perfectly illustrates how proactive statutory procedures protect property, mitigate risk, and keep a high-spec build on track.

Here is a technical look at how we successfully navigated the Party Wall Act 1996 for this project, transforming potential boundary disputes into a textbook example of smooth contract administration.

Project Overview & Statutory Triggers

The project involved a deep ground-floor rear and side-return extension designed to create an open-plan kitchen diner. Given the structural layout of the Victorian terrace, several elements of the proposed scheme strictly fell under the scope of the Act:

  • Section 2(2)(a) & (f) – Structural Alterations: The design required cutting into the shared party wall to insert heavy structural steelwork (RSJs) to support the wide, open-plan opening.
  • Section 6(1) – The 3-Meter Notice: To comply with modern building regulations, the new extension required deep foundations. Because these excavations fell within 3 meters of the adjoining structures and extended below the level of their shallow, historic footings, a Section 6 Notice was mandatory.
  • Section 1 – Building on the Line of Junction: The new flank wall was designed to sit precisely on the boundary line to maximize the client’s internal floor area without encroaching.

The Administration Process: From Notice to Award

For this SW6 property, the adjoining owners opted to dissent to the initial notices—a completely standard and prudent reaction in prime London markets where property values are exceptionally high.

Our role as the surveyor was to ensure that the statutory dispute mechanism ran seamlessly without delaying the contractor’s mobilization date.

1. Executing the Schedule of Condition

Before any structural work or digging commenced, we conducted a rigorous, forensic Schedule of Condition of the adjoining properties. Period properties in Fulham are highly susceptible to movement and hairline plaster cracks. Documenting every pre-existing defect textually and photographically was vital to protect the Building Owner from spurious claims, while ensuring the Adjoining Owner had clear recourse if structural movement did occur.

2. Resolving Special Foundations & Details

A key point of negotiation during the dispute phase involved the foundation design. We worked closely with the structural engineers to review the calculation details, ensuring that the excavation methods (utilizing hand-digging and sequential underpinning where necessary) minimized vibration and structural risk to the neighboring party wall.

3. Drafting and Serving the Party Wall Award

By collaborating effectively with the Adjoining Owner’s surveyor, we successfully drafted and served a robust Party Wall Award. The document explicitly detailed:

  • Permitted working hours for high-vibration and noisy operations (essential for high-density residential streets in Fulham).
  • Right of access provisions for the contractors.
  • Strict guidelines on structural monitoring during the excavation phase.

The Outcome: Risk Mitigated, Project Delivered

Because the Party Wall procedures were initiated early and managed with technical precision, the Award was signed and served well ahead of the contractor’s start date.

The extension has now been successfully completed to an exceptional standard. Thanks to the comprehensive Schedule of Condition and clear structural guidelines embedded in the Award, the heavy works were executed without a single dispute or damage claim arising from the neighbors.

This project reinforces a fundamental truth in our industry: proactive, professional party wall administration is not a hurdle to a build—it is the insurance policy that guarantees its success.
